Government agencies are required to use Performance-Based Service Contracting
for most contracts. They must specify the performance requirements or require
prospective contractors to propose performance requirements. In addition, a
“quality assurance” methodology is required and the terms of Service Level
Agreements (SLAs), which include incentives or penalties, must be negotiated.
Agency program and contracting personnel may lack the experience, knowledge, and
skill to formulate SLAs, quality assurance methods, and incentives and penalties
that protect the Government. Contractors may also lack the experience,
knowledge, and skill to design solutions that are “right sized”, that is,
powerful enough to satisfy SLAs but not overly designed and therefore overly
costly.
